CEQA is often cited as an impediment to infill and transit-oriented development that benefits the region environmentally. Yet CEQA is just a process for disclosing potential environmental impacts as input to public review and decision-making. CEQA already has categorical exemptions for development of infill parcels, but it’s not widely used and recent case law raises issues. State legislation passed (SB226) and proposed would expedite the process for projects that further SB375 and AB32 policies. Is the problem CEQA, or the way it is commonly applied? Can local agencies structure their CEQA significance thresholds and General Plan policies to facilitate Smart Growth Development? Come hear a panel discuss these questions and ways to make CEQA a friend of Smart Growth while meeting CEQA’s legal requirements.

- Eileen Fogarty, President of The Fogarty Group and former Director of Planning and Community Development in Santa Cruz, CA, Alexandria, VA, and Santa Monica, CA, where she employed EIR goals and objectives that stepped away from traditional sprawl inducing LOS analysis of infill development impacts to reduce GHG emissions and create sustainable urban centers.
- Al Herson, FAICP, a noted Environmental Attorney and Planner with Sohagi Law Group in Sacramento and co-author of California Environmental Law and Policy: A Practical Guide, the CEQA Deskbook (2nd Edition), and the NEPA Book.
